Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between you and HealthTrajectory ("we", "us", "our") governing your use of healthtrajectory.ai and related pages (the "Service"). By accessing or using the Service or joining the early-access list, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 16 years old and able to form a binding contract. If you use the Service for an organization, you confirm you are authorized to bind it.
2. What the Service is
The Service is the website for HealthTrajectory, a mobile app that is not yet released. It lets you learn about the app and join an early-access list. Joining the list is free and does not guarantee access, a launch date, a feature or any particular product. We may change, delay or discontinue the app or the Service at any time without liability to you.
3. Not medical advice
HealthTrajectory is not a medical device and does not provide medical advice, diagnosis or treatment. Nothing on the Service is medical, legal, financial or other professional advice, and it is for general information only. Do not rely on it as a substitute for advice from a qualified health professional, and do not delay or ignore professional advice because of anything you read here. If you think you may have a medical emergency, call your local emergency number immediately.
4. Early-access list
When you join the list you confirm that the information you give us is accurate and that you want to receive launch updates from us by email. You can unsubscribe at any time. Any future app will have its own terms, which you will need to accept before using it.
5. Acceptable use
You agree not to: break the law or others' rights; submit false or another person's information; send spam or use the sign-up form to send anything other than your own details; interfere with or attempt to breach the security of the Service; probe, scrape or harvest content or data by automated means, or use content to train machine-learning or AI models, without our written permission; or use the Service to compete with or harm us.
6. Our content and intellectual property
The Service, our design, branding, logos and all content we publish are owned by us or our licensors and protected by copyright, trademark and other laws. "HealthTrajectory", "Trajectory Score" and our logo are names and marks of HealthTrajectory. You may read the content, link to it, and share short excerpts with attribution and a link back, and print or save a single copy for personal, non-commercial use. All other use, including copying, republishing, selling or creating derivative works, requires our written permission.
7. Feedback
If you send us ideas or suggestions, you agree we may use them without restriction or payment to you.
8. Third-party sites and content
The Service may link to third-party websites and services, such as X. We do not control them and are not responsible for them, and your use of them is at your own risk and subject to their terms.
9. Copyright complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to support@healthtrajectory.ai that includes: your name and contact details; a description of the copyrighted work; the exact web address of the content you say infringes it; a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove or disable access to the material. Knowingly false notices may expose you to liability.
10. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HEALTHTRAJECTORY AND ITS OWNERS, CONTRACTORS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE MAY NOT APPLY TO YOU IN FULL.
12. Indemnity
You will defend, indemnify and hold harmless HealthTrajectory and its owners, contractors and affiliates from claims, damages and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms or any law.
13. Termination
We may suspend or end your access, and remove you from the early-access list, at any time and for any reason, including breach of these Terms. You may stop using the Service or ask us to remove you from the list at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law rules. You and we agree that the state and federal courts located in Connecticut have exclusive jurisdiction over any dispute, and you consent to their personal jurisdiction. Before filing a claim, you agree to contact us at support@healthtrajectory.ai and give us 30 days to try to resolve it informally.
15. Changes to these Terms
We may update these Terms from time to time. The version posted on this page, with its effective date, is the current version and replaces all earlier versions from the date it is posted. If the law requires us to notify you of a change, we will email the address you gave us. Where the law does not require notice, we may simply post the update here, and your continued use of the Service means you accept it. Please check this page periodically.
16. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for delays caused by events beyond our reasonable control.
